Facebook Stock Perks Up On Reports Of $5B Settlement With U.S. Regulators

Multiple published reports that the Federal Trade Commission voted to approve a $5 billion settlement with Facebook sent shares in the tech giant up 1% in the final minutes of Friday's trading session.
It wanted to assess how the company is treating the personal data of its billions of users (one of many issues that has led to increasing calls for Facebook to be broken up). In March 2018, after a string of revelations about the rogue data firm Cambridge Analytica soon metastasized into larger trust issues for Facebook, the FTC opened an investigation into the company.
Founder and CEO Mark Zuckerberg has frequently emphasized in his recent remarks, including before Congress, that he is open to regulation. In addition to the money involved (certainly not a fortune by the company's ultra-rich standards), the decision is expected to usher in a new era of restrictions on how Facebook handles users' personal information.
If it is approved by the U.S. Department of Justice, the $5 billion fine would be the stiffest penalty ever assessed against a technology company. Shares finished at $204.87, up nearly 2% on the day, and have reached their highest level in nearly a year. Investors increasingly see the company's results more than compensating for any concerns about the potential harm of regulation.
The 3-2 vote followed party lines at the Republican-controlled agency, according to numerous reports. When contacted by Deadline, Facebook and the FTC both declined to comment on the settlement.
"We believe it's premature to assume any significant near-term downside on tech-related antitrust concerns" at the tech giants, he wrote. Analyst John Blackledge of Cowen issued a note to clients late Friday mirroring the market's reaction and noting other regulatory probes of Google parent Alphabet as well as Amazon.
On Thursday, a "social-media summit" was held at the White House, but Facebook, Twitter and YouTube were not invited. Trump has criticized Silicon Valley companies for allegedly maintaining a bias against conservative views and even "trying to rig the election" in 2020.” />

Twitter Goes Down Again In Widespread Outage; Cause Identified – Update

UPDATED with cause: Twitter is experiencing a broad outages of its services, the social media site said Thursday, saying on its official status page that the problem is due to an internal configuration change that is now being fixed.
It's the second notable outage for Twitter this month. The platform experienced temporary outages relating to DM delivery and notifications on July 3, the same day Facebook, Instagram and WhatsApp users saw those services down for most of the day.
"Some people may be able to access Twitter again and we're working to make sure Twitter is available to everyone as quickly as possible," it wrote in its update.
The gathering is mostly of conservative influencers Trump follows who have complained that they are consistently marginalized on the major platforms. Todaay's outage comes the same day President Donald Trump is hosting a Social Media Summit at the White House that does not include the biggest social media networks — including Twitter.
Twitter recently announced that disclaimers would be attached to tweets from world leaders that violate the site’s community standards rules. More recently, a New York appellate court upheld an earlier decision that Trump violated the First Amendment by blocking Twitter users.” />
Most queries on the social media platform were resulting in an error page for users all over the world. The side DownDetector reported the issues began just before 3 PM ET impacting Twitter's website and Android and iPad apps.

Kellyanne Conway To Reporter On Hatch Act: “Can You Leave, Please?”


White House deputy press secretary Steven Groves dismissed the OSC's reasoning as "deeply flawed" and a violation of Conway's "constitutional rights to free speech and due process."

White House adviser Kellyanne Conway is, apparently, in no mood to discuss her alleged violations of the Hatch Act. MSNBC White House reporter Eamon Javers added this terrific little insider's tidbit to the latest Conway controversy.
News broke this morning that the U.S. Office of Special Counsel – an independent government agency unrelated to the Mueller investigation – is recommending that Conway be removed from her job for repeated violations of the Hatch Act. (The Hatch Act bars federal workers from engaging in partisan politics.)
According to the OSC, Conway has repeatedly disparaged Democratic presidential candidates "while speaking in her official capacity during television interviews and on social media."


Last month, when asked about the Hatch Act by White House reporters, Conway responded, "Blah, blah, blah. Given that the president has the final say over Conway's employment fate, her indignant non-response to MSNBC's Javers is unsurprising. If you’re trying to silence me through the Hatch Act, it’s not going to work. Let me know when the jail sentence starts."

“I’m The Captain,” Bill Barr Tells Senators, Calling Robert Mueller Report “My Baby”

Hours after it began, the hearing came full circle, ending with Barr describing as "snitty"  Mueller's letter urging him to stop mischaracterizing the report.
"Why should you?"” />
"It's deeply troubling he made a decision whether to charge and did not review the evidence," she told reporters. "This attorney general lacks all credibility and has compromised the American public's ability to believe he is a purveyor of justice."
When Feinstein noted Trump “essentially” attempted to change the lawyers’ account, "in order to prevent further criticism of himself,” Barr shot back “that’s not a crime.” That's because it would be impossible for the government to establish, beyond a reasonable doubt, that Trump understood that he was instructing McGahn to say something false.
"No," Barr answered, demonstrating "snitty."
Committee chairman Lindsey Graham, who has already announced the Mueller investigation is "over for me," announced he had not read the full Mueller report.
Out in the hall, Harris took a victory lap:
"I'm trying to grapple with the word 'suggest'. They have not asked me to open an investigation," he responded.
Stealing Trump’s shtick, Graham attacked the press covering the gathering, suggesting we "substitute 'Clinton' for 'Trump' in the probe and "see what all these people with cameras would be saying about this" while pointing to the back of the room. Graham opened the hearing announcing “the first order of business: to try to cool the room down“  – then did the opposite.
Barr defended his use of “spying” when he plagiarized Trump in describing authorized justice department investigative activities, insisting it’s a “good English word.”
She then got him to acknowledge he had not looked at the underlying evidence in Mueller's report before announcing he had determined Trump did not obstruct justice.
“History will judge you harshly, and maybe a bit unfairly, because you seem to have been the designated fall guy for this report,” Blumenthal told Barr.
"Perhaps they've suggested?" she persisted.
In his report Mueller argued that, with regard to obstruction he was barred reaching a conclusion whether Trump obstructed justice, no matter the evidence collected, because DOJ bars indicting a sitting president.
“I think your credibility is undermined within the department, in this committee, and with the American people,” Blumenthal charged.
If Mueller had decided he was unable to charge President Donald Trump with obstruction due to a previous DOJ ruling about a sitting president, Barr said Mueller should not have investigated the instances of potential obstruction, 10 of which are spelled out in Mueller’s 400+ page report.
“I think that conclusion is inescapable, in light of the four-page summary, and then the press conference you did on the day it was released, knowing that you had in hand a letter from the special counsel saying that he felt you mis-characterized his report.”
“We felt that that episode, the government would not be able to establish obstruction,” Barr answered.
Dianne Feinstein asked Barr if existing law prohibited efforts to get a witness to lie, when questioning him about McGahn's account to Mueller that Trump tried to get him to change his testimony about jettisoning Mueller. In one of the more eyebrow-raising exchanges, committee ranking Dem, Sen.
"I’m the captain," Attorney General Bill Barr told the Senate Judiciary Committee on Wednesday, taking potshots at special counsel Robert Mueller hours after The Washington Post and The New York Times revealed Mueller had urged Barr to publicly release the report’s summaries, arguing Barr’s 4-page CliffsNotes summary of the 400-page report had undermined public confidence in Mueller's investigation.
Blumenthal blasted Barr for effectively “clearing” Trump with his various claims about Mueller’s report.
The question was, why were those investigated… if you weren’t going to reach a decision?” Barr “asked” Mueller, dinging him in absentia. “The investigation carried on for a while as additional episodes [of possible obstruction] were looked into.
"It seems you would remember something like that," Harris said like she meant it to sting.
Barr made clear to the senators, and the millions of viewers watching across MSNBC, CNN, Fox News Channel and various broadcast networks interrupting their schedules with “special reports,” Mueller’s report is “my baby” to handle as he sees fit.
"I don't know," he answered, under oath.
Barr, however, declined to agree former White House counsel Don McGahn would be allowed to testify before the group. Amy Klobuchar wanted to know if Mueller had, as Trump has stated, reviewed Trump's taxes and those of his company in the course of his investigation. Barr said he did not know and suggested she ask Mueller when he came to testify before the committee.
Richard Blumenthal, who was not with her when she spoke to reporters, expressed himself similarly during questioning. Dem Sen.
Asked by Blumenthal if anyone had "memorialized the conversation" that followed when Barr called to ask Mueller, as Barr put it "what's up with the letter?" Barr said notes were taken during the call.
Barr brawled with Dems on the committee who accused him of acting like Trump’s personal attorney, rather than the top legal official for the country.
Asking Barr if Trump or anyone at the White House has asked him to open an investigation of anyone, Barr stumbled, asking her to repeat the question.
"I wouldn't say suggested," Barr said.
Kamala Harris was first to draw blood. Sen.
"Hinted?" Harris continued, not willing to let go.
"May we have those notes?" Blumenthal asked.

Four national TV and radio correspondents who cover Donald Trump's White House sized up the many challenges of doing so during a lively panel at the NAB Show in Las Vegas. One of the biggest is the fact that he lately has preferred interacting with TV reporters under the whirring blades of Marine One rather than a controlled setting of an official indoor briefing.
All four correspondents decried Trump's intensifying efforts to label the press as not just "fake news" but "the enemy of the people." They also lodged familiar complaints about the infrequency of official press briefings. Portnoy noted that there have been just four in the past six months.
And the president might take our question." "You still have the opportunity to ask the president questions," Portnoy said. "What we don't have is the regular opportunity to interact with the press secretary in a controlled way that allows the American people to understand what's happening. The nature of that access is the crux of the matter, however. Bush had been at the same point in their first terms. At the same time, Portnoy said one study of the president's first 18 months in office found him to be more accessible than Barack Obama or George W. Robert Mueller Investigation Is Over After 675 Days

It's a huge moment for the White House, the investigation having hung over Trump since he took office, and provided a huge ratings magnet for TV networks.
Five people have been sentenced to prison and 16 Trump associates have been shown to have had contact with Russians during the campaign and the transition. In the widely televised drama, there have been 37 defendants, including six Trump associates who have been charged with crimes. With submission of the report, there will be no more indictments from Mueller.
In his letter to the chairs of those committees, Barr said Mueller had concluded his investigation or Russian interference into the 2016 election and related matters. Mueller having turned in his report, Barr notified the House and Senate Judiciary Committees.
Barr will explain to them any instances in which DOJ  has overruled Mueller. In his letter, Barr told the committee chairs there was "no such instance."
White House's first reaction, via Press Secretary Sarah Huckabee Sanders:
TV news outlets will have to wait a while, however, to learn if there is any evidence of collusion between Trump's camp and the Russians in election meddling, and whether Trump himself was aware of the rannygazoo.
TV news outlets had been on high alert the past few days, staking out Mueller's office for TMZ-like sightings of the special counsel driving up in a baseball cap; much was read into his having not gone out to lunch on Thursday. And reporters began to foam over when Deputy AG Rod Rosenstein announced he was not stepping down shortly, as originally announced, but would stick around a while longer; Washington navel lint gazers said he was doing so to provide a heat shield between newly appointed AG Barr and mercurial Trump.
Barr will share some version of the findings with Congress and the public. He has not committed to making the report public. Democrats, who now control the House of Representatives, want to see entire report, but the House voted unanimously that the entire report should be made public.

Special Counsel Robert Mueller has handed in his report to Attorney General Bill Barr, ending 675 days of probing of Russian meddling in the 2016 election and any participation by folks from President Donald Trump's campaign or transition team.
Barr, in his letter, said he would go over with them the report's "principal conclusions" as soon as this weekend. Barr will make a version of the report and give that, not Mueller's report, to Congress.
Trump has made it clear the White House believes  it should get to review the entire summary to assert privilege as it sees fit. Portions of that summary will be shared with the White House for possible executive privilege issues.

Bill Shine’s Hefty Fox News Exit Package Divulged By White House

A rep from 21st Century Fox did not immediately respond to Deadline's request for comment.
Shine joined Team Trump in June, continuing the Foxification of the White House in the era of a reality-star president. The exec replaced another FNC refugee, Hope Hicks, who abruptly resigned as comms director in February. Her exit came one day after testifying before the House Intelligence Committee.
The figures came from a White House disclosure form obtained by CNBC, which said it obtained it only after "dozens of requests to the Office of Government Ethics."
Fox News, the Fox broadcast network and local TV stations will be the primary assets of Fox once the $71.3 billion transaction is completed.” />
Ailes and longtime former Fox News host Bill O'Reilly each got hefty exit packages from the network, reported to be up to $40 million and $25 million, respectively.
After steering communications for the Trump campaign and then taking a prominent White House role, she now is working at Fox and will lead corporate communications for the company after the closing of its merger with Disney in the coming weeks. Another connection is Hicks. The Shine disclosure offers more ammunition to critics of Donald Trump, who have raised questions about the close ties between the president and Fox News.
According to the form, Shine was paid $1.46 million in salary, $8.4 million in severance and $7 million of future bonuses and options (read the filing here).
In recent years, Shine had become entangled in the web of sexual misconduct and harassment scandals that plagued Fox News while his mentor, the news network's late architect Roger Ailes, was still at the helm. Although he long has denied any wrongdoing, Shine's long tenure coincided with that of Ailes, who was accused of sexual misdeeds in numerous lawsuits by on-air talent and staff before being ousted in 2016. Ailes died in May 2017.

On another rough day for Wall Street, major stock indices lost more ground, with the Dow Jones Industrial Average, Nasdaq and S&P 500 all now below where they began 2018.
Facebook and Google, each of which has been through the wringer of late, managed to gain a fraction, joining a small number of tech and media issues to avoid red figures. Apple finished in red numbers for the seventh straight session, shedding 5% to close at $176.98, while Amazon and Netflix each surrendered 1%.
The Dow skidded 2% to finish at 24,463.47, while the S&P swooned a shade less than 2% to settle at 2,641.88. The Nasdaq fell another 1.7% to 6,908.82, its lowest level in seven months, dragged down by the same tech stocks that paced market gains earlier this year.
Multiple factors have been weighing on stocks this fall, among them rising interest rates and anxiety about trade relations with China. In recent days, major retailers Target and Kohl's also issued disappointing earnings and forecasts. There is also a pervasive sense among investors that the bull market has gotten overextended and 2019 could bring more economic uncertainty.
"I think your tech stocks have some problems." "I think the rate's too high. I think we have much more of a Fed problem than we have a problem with anyone else," Trump said.

CNN: White House Has “Fully Restored” Jim Acosta’s Press Credential – Update

"The White House is continuing to violate the First and 5th Amendments of the Constitution," CNN said in a statement yesterday. "These actions threaten all journalists and news organizations. Jim Acosta and CNN will continue to report the news about the White House and the President."
According to CNN, Acosta has received a formal letter from the White House "outlining a 'preliminary decision' to suspend his pass again once the restraining order expires." But the court order was temporary, and would expire after two weeks. Kelly ruled that Acosta's due process rights had been violated. Trump's White House was forced to restore Acosta's credentials last week after Judge Timothy J.
According to a report by CNN's Brian Stelter today, the latest White House letter to Acosta was signed by press secretary Sarah Sanders and deputy chief of staff for communications Bill Shine. "The letter signaled that the Trump administration wants to continue fighting Acosta, despite the round one setback in court, rather than seeking an out-of-court settlement," Stelter writes.
Now CNN and Acosta are seeking a hearing on a preliminary injunction for the week of November 26 or soon thereafter.
CNN also said that the Donald Trump administration has announced a new set of guidelines for reporters at White House news conference but did not give details.


The cable news org said it received a letter from Press Secretary Sarah Huckabee Sanders that read: “Having received a formal reply from your counsel to our letter of November 16, we have made a final determination in this process: your hard pass is restored,. UPDATED, 1:02 PM: CNN tweeted today that the White House has "fully restored" to his press credential, but it gave no details. The President is aware of this decision and concurs.” Should you refuse to follow these rules in the future, we will take action in accordance with the rules set forth above.
PREVIOUSLY, 6:39 AM: CNN has responded to yet another press-pass threat from the President of the United States by asking the U.S. District court for an emergency hearing.
CNN's report indicates that "the network and Acosta 'remain hopeful' that the parties "can resolve this dispute without further court intervention."” />
The network's request for an emergency hearing follows a new warning from the White House that CNN's Jim Acosta could have his press pass revoked again at the end of November.
CNN's lawyers now say that the White House letter is an "attempt to provide retroactive due process."

Weekend Today Officially Adds Peter Alexander As Co-Anchor

He has been NBC's White House correspondent since 2012. Alexander, age 42, joined NBC News in 20 04, and has covered numerous international stories, including Iraq's 2005 election and Osama bin Laden's death.

Peter Alexander will have a busy schedule coming up. He is officially joining Sheinelle Jones and Dylan Dreyer on Weekend Today as the new co-anchor, but will maintain his White House correspondent role and be based in Washington during the week, coming to New York to co-anchor the Saturday broadcast.
The Weekend Today transition will be smooth, as Alexander has been sitting in for former co-anchor Craig Melvin, who left in August to focus on his weekday work at MSNBC and Today.
"There is no one better or more qualified to be sitting in this very Today show seat," said co-anchor Savannah Guthrie.
On Saturday's program, Melvin and several other NBC News/Today staffers congratulated Alexander. on making things official.

‘The View’ Hosts Under Fire For (Almost) Mocking Melania Trump Accent

The View hosts lashed out at the First Lady, bringing up her past issues of plagiarizing a Michelle Obama speech and her support of the idea that Barack Obama was not born in the US.
In the editorial, an anonymous White House source claimed that certain people were working against the President's more outrageous whims and plans. The incident happened during a discussion on the anonymous op-ed that appeared this week in the New York Times.
Hostin then began reading Melania Trump’s statement sarcastically. When it appeared she was about to mock the First Lady in a faux Slovenian accent, Goldberg warned her not to do it. Hostin then read the story in a normal voice.” />
ABC's The View hosts are under fire from Melania Trump's chief spokesperson, accused of mocking the First Lady's Slovenian accent.
Whoopi Goldberg, Joy Behar, Abby Huntsman, and Sunny Hostin squared off on the issue.
Stephanie Grisham, chief spokeswoman in the East Wing of the White House, called The View’s hosts "disrespectful and hypocritical" for "mocking someone’s accent."
She concluded:"People with no names are writing our nation's history. If a person is bold enough to accuse people of negative actions, they have a responsibility to publicly stand by their words and people have the right to be able to defend themselves." Words are important, and accusations can lead to severe consequences.
Unidentified sources have become the majority of the voices people hear about in today's news." To the writer of the op-ed – you are not protecting this country, you are sabotaging it with your cowardly actions. "The press should be fair, unbiased and responsible. "Freedom of speech is an important pillar of our nation's founding principles and a free press is important to our democracy,’ she said in a statement.

Bob Woodward’s New Book Scorches Earth Under Donald Trump, With John F. Kelly Proclaiming, “We’re In Crazytown” – Update

“Let’s f–king kill him! Let’s kill the f–king lot of them.” While the in-fighting and anxiety about Mueller have been covered elsewhere, Woodward also raises other issues about Trump's foreign-affairs dealings. Let’s go in. After a chemical weapons attack in Syria, Woodward reports, Trump said he wanted to assassinate Syrian President Bashar al-Assad.
Despite the anonymity of some sources, Post political writer Aaron Blake said the account should not be automatically dismissed.
These are also anonymously sourced anecdotes," Blake wrote. "But the book also paints a portrait that is likely to be filled out by others in the days, weeks, months and years ahead." "Some people will still doubt the claims in the book, because 35 to 40 percent of the country is predisposed toward doing that and has been for the better part of three years.
The White House hit back promptly, delivering a set of statements deriding the book as "fabricated stories."

Many interviews were conducted on “deep background,” meaning the information is used without an explanation of who provided it. Woodward says it is based on hundreds of hours of interviews with White House figures and witnesses. He also drew from meeting notes, personal diaries and government documents. The book, Fear: Trump in the White House, will officially be published on September 11 by Simon & Schuster.

While made-for-TV dramatic, the announcement was not surprising, the White House having said last month that Trump was mulling whether to yank clearance of Brennan and former FBI director James Comey; McCabe, the former deputy FBI director; Clapper; former national security adviser Rice; and Hayden.
The thunderbolt comes one day after Brennan scolded Trump for his tweet calling Omarosa a "dog" as the latest example of Trump's failure to "live up to minimum standards of decency, civility & probity." He told Trump his behavior is "so dangerous for our Nation":
Book-touring Omarosa has said she heard it. Her book tour had been met with frenzied Trump tweeting, most recently the one in which he called her "dog", which dominated Sarah Huckabee Sanders' Tuesday press briefing, at which she declined to guarantee that there is not a tape in which Trump used the n-word.

Washington Post Staff Issues Open Letter To Jeff Bezos As Labor Dispute Heats Up

Donald Trump Officially Nominates White House Doctor As VA Secretary – Update

Shulkin initially pushed back at VA inspector general's determination his chief of staff misled ethics officials to get clearance for airfare for his wife, speculating her email had been hacked. He later apologized and paid back the cost of her airfare, but continued to allege Trump appointees were targeting him. Shulkin's sun began to set when he was accused of ethics violations over a European trip taken last year.
He was previously appointed by Obama as undersecretary for health at the VA in July of 2015. Shulkin survived 13 months in Trump's cabinet.

White House Explains Donald Trump’s Use Of Slur At Event Honoring Native American Veterans

White House Press Secretary Sarah Huckabee Sanders lept like Nijinsky around questions about President Donald Trump having using a racial slur on Monday during a White House ceremony at which he purported to honor Native American “code talkers” who served in World War II.
